Please read these Terms and Conditions ("Terms") carefully before enrolling in any program with Canadian Academy of Defensive Driving Inc. ("CADD," "we," "us," or "our"). These Terms constitute a legally binding agreement between you and Canadian Academy of Defensive Driving Inc. By registering for a course, making a payment, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services or enroll in our programs.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising from these Terms shall be resolved in the courts of Ontario.

1. Definitions

"BDE Course" means the MTO-approved Beginner Driver Education program offered by CADD.

"DriveTest Centre" means the government-authorised facility responsible for conducting Ontario driver's licence road tests.

"MTO" means the Ministry of Transportation of Ontario.

"Student" or "You" means any individual who registers for, enrols in, or participates in any course or service offered by CADD.

"Instructor" means a licensed driving instructor employed or contracted by CADD to provide driving instruction.

"Services" means all courses, programs, driving lessons, and related services provided by CADD.

"Website" means the official CADD website at caddonline.greenhardwares.com and any associated subdomains.

2. Enrollment and Registration

Enrolment is confirmed only upon receipt of full payment or an approved payment arrangement as agreed to in writing by CADD management. CADD reserves the right to refuse enrolment to any individual who does not meet program requirements, provides false or misleading information, or whose conduct poses a safety risk to our staff or other students.

2.3 Age Requirements

Students under the age of 18 must have a parent or legal guardian co-sign the registration form and agree to these Terms on behalf of the minor. The parent or guardian is jointly and severally liable for all obligations under these Terms.

3. Payment Terms

3.1 Fees and Taxes

All fees are listed in Canadian dollars (CAD) and are subject to applicable Harmonized Sales Tax (HST) unless otherwise stated. Prices may change without notice; however, once you have enrolled and paid for a course, your fee will not increase.

3.2 Payment Due

Full payment is required prior to the commencement of in-car lessons unless otherwise arranged in writing with CADD management. Payment plans, where offered, must be adhered to according to the agreed schedule. Late payments may result in suspension of services and additional administrative fees.

3.3 BDE Course Outstanding Payments

All outstanding payments for the Beginner Driver Education (BDE) Course must be paid in full prior to CADD certifying the student with the Ministry of Transportation (MTO). No certification will be submitted to the MTO until all fees, charges, and outstanding balances related to the BDE Course have been settled. This is a strict condition of enrolment, and no exceptions will be made. Students with outstanding balances will not receive their MTO insurance certificate, driver's licence history update, or any proof of course completion until payment is received in full.

3.4 Vehicle Rental for Road Test

Any vehicle rental from our school for the purpose of a road test must be paid for in full at least twenty-four (24) hours before the scheduled road test time to confirm the booking. Failure to pay within this timeframe may result in the cancellation of the vehicle rental without notice. No refund will be provided for road test vehicle rentals cancelled by the student less than twenty-four (24) hours before the scheduled test.

3.5 Accepted Payment Methods

We accept the following payment methods: credit card, debit card, e-transfer, cash, and such other methods as may be communicated from time to time. Payments made by credit card are processed through secure third-party payment processors.

4. Third-Party Fees and Responsibilities

4.1 DriveTest Centre and MTO Fees

Any payments owed to the DriveTest Centre for road test bookings, or to the Ministry of Transportation (MTO) for driver's licence renewal, reinstatement, replacement, or any other MTO service, are NOT the responsibility of Canadian Academy of Defensive Driving Inc. These are government-imposed fees that must be paid directly by the student to the respective third party. CADD is not affiliated with, and assumes no liability for, any fees charged by DriveTest Centres, the MTO, ServiceOntario, or any other government agency.

4.2 Student Responsibility for Third-Party Fees

The student must ensure that any outstanding fees owed to third parties, including but not limited to the DriveTest Centre, the MTO, ServiceOntario, insurance providers, and any other entities not affiliated with Canadian Academy of Defensive Driving Inc., are paid in full. CADD bears no responsibility for delays, cancellations, or consequences arising from a student's failure to pay third-party fees. Students are solely responsible for verifying and settling all such obligations directly with the applicable third party.

4.3 Third-Party Services Disclaimer

References on our website or in our marketing materials to third-party services, including road test booking services, licence renewal services, or insurance providers, are provided for informational purposes only. CADD does not endorse, guarantee, or assume any responsibility for the services, products, or actions of any third party. Any disputes or issues arising from third-party services must be resolved directly between the student and the third party.

5. Refund Policy

5.1 Refund Requests

Refund requests must be submitted in writing to info@caddonline.ca. Refund eligibility is determined based on the portion of the course completed, applicable MTO regulations, and the specific circumstances of the request.

CADD reserves the right to withhold refunds for students expelled under our harassment or substance policies (as detailed in Sections 10 and 11 of these Terms). No refund will be provided for any course or lesson cancelled due to a violation of these Terms or any CADD policy.

5.4 Processing Time

Approved refunds will be processed within fourteen (14) business days using the original payment method where possible. CADD is not responsible for delays caused by financial institutions or payment processors.

6. Cancellation and Rescheduling Policy

6.1 Lesson Cancellations by Student

Students must provide at least twenty-four (24) hours' notice to cancel or reschedule a driving lesson. Cancellations made with less than twenty-four (24) hours' notice may be subject to a cancellation fee or forfeiture of the lesson. No-shows (failure to attend a scheduled lesson without notice) will result in forfeiture of the lesson with no refund or rescheduling.

6.2 Lesson Cancellations by CADD

CADD reserves the right to cancel or reschedule lessons due to unsafe weather conditions, vehicle maintenance issues, instructor illness, or other circumstances beyond our reasonable control. In such cases, we will make reasonable efforts to reschedule the lesson at no additional cost to the student.

6.3 Road Test Cancellations

Students are responsible for cancelling or rescheduling their road test directly with the DriveTest Centre in accordance with the DriveTest Centre's cancellation policies. CADD is not responsible for road test fees forfeited due to late cancellations or no-shows.

7. Beginner Driver Education (BDE) Course Completion Policy

All students enrolled in the Beginner Driver Education (BDE) Course must complete the full program within one (1) year from the date of registration. Failure to complete the course within this timeframe will result in disqualification from receiving the MTO insurance certificate and driver's licence history update, in accordance with the guidelines provided by the Ministry of Transportation.

No extensions will be granted beyond the one-year window except under extraordinary circumstances, as approved in writing by CADD management at its sole discretion. It is the student's responsibility to ensure timely completion of all theory instruction, in-vehicle training, homework, and any other course requirements within the one-year period.

8. Driver's Licence Requirement Policy

All students must possess and present a valid Ontario driver's licence during any of our courses, particularly when participating in practical, in-vehicle driving lessons. The licence must be appropriate for the vehicle class being operated and must not be expired, suspended, or revoked.

For any of our courses that require driving, students must carry their driver's licence at all times during the lesson and must produce it upon the instructor's request. Failure to present a valid driver's licence upon the instructor's request grants the instructor full authority to terminate the lesson immediately. No refund or rescheduling will be provided for lessons missed due to failure to produce a valid licence.

Students who arrive for a lesson without a valid driver's licence will be considered a no-show, and the lesson will be forfeited. It is solely the student's responsibility to ensure that their licence is valid, current, and in their possession before every lesson.

9. Student Conduct and Responsibilities

Students are responsible for any damage caused to training vehicles through negligence, reckless behaviour, wilful misconduct, or violation of traffic laws during instruction. CADD carries commercial general liability insurance; however, this does not cover damage caused by student misconduct.

CADD is not responsible for the loss, theft, or damage of personal belongings brought to lessons or left in training vehicles. Students are advised to keep valuables with them at all times.

10. Sexual Harassment and Verbal Harassment Policy

Canadian Academy of Defensive Driving Inc. maintains a stringent zero-tolerance policy towards sexual harassment and verbal harassment. This policy applies to all students, parents, guardians, instructors, staff members, and any other individuals participating in or attending CADD programs or premises.

Any student or their parent/guardian found engaging in harassment, including abusive language directed towards any driving instructor or staff member, will face immediate consequences, including:

Any individual who experiences or witnesses harassment is encouraged to report it immediately to CADD management at info@caddonline.ca or (416) 642-8549. All reports will be investigated promptly and confidentially.

11. Alcohol, Marijuana, and Medication Policy

Operating a motor vehicle under the influence of alcohol, marijuana (cannabis), or any impairing medication is unlawful in Canada and strictly prohibited during all CADD programs and lessons.

Students are strictly prohibited from attending any lesson, course, or CADD activity while under the influence of:

If a driving instructor suspects that a student is under the influence of any substance, whether legal or illegal, the instructor reserves the right to cancel the lesson immediately. In such instances:

This policy is implemented to ensure the safety and well-being of all individuals enrolled in our driving courses and to comply with legal requirements and regulations, including the Criminal Code of Canada, the Highway Traffic Act of Ontario, and all applicable federal and provincial laws. It is incumbent upon every student and parent/guardian to acquaint themselves with and adhere to this policy.

12. Limitation of Liability

12.1 General Limitation

To the maximum extent permitted by applicable law, Canadian Academy of Defensive Driving Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

In no event shall CADD's total liability to you for all claims arising out of or relating to these Terms or our services exceed the total amount paid by you to CADD for the specific course or service giving rise to the claim.

All content on our website, including but not limited to text, images, videos, logos, curriculum materials, course content, and proprietary training methodologies, is the intellectual property of Canadian Academy of Defensive Driving Inc. and is protected by Canadian copyright law, trademark law, and other applicable intellectual property laws.

Unauthorized reproduction, distribution, modification, display, performance, or commercial use of any CADD intellectual property is strictly prohibited without prior written consent. Students are granted a limited, non-exclusive, non-transferable licence to access course materials solely for personal educational purposes during their enrolment.

15. Website Use

You agree not to use our website for any unlawful purpose or to transmit any material that violates the rights of others. Prohibited activities include:

16. Electronic Communications and Marketing

16.1 Consent to Electronic Communications

By providing your contact information to CADD, you consent to receive electronic communications from us, including emails, text messages (SMS), and telephone calls, regarding your enrolment, lessons, schedule, and service updates. Standard message and data rates may apply to SMS communications.

16.2 Marketing Communications

With your consent, we may send you promotional communications about our courses, special offers, and new services. You may opt out of marketing communications at any time by clicking the unsubscribe link in emails, replying STOP to text messages, or contacting us at info@caddonline.ca.

16.3 CASL Compliance

All commercial electronic messages sent by CADD comply with Canada's Anti-Spam Legislation (CASL). Each message will identify CADD as the sender, provide our contact information, and include a functional unsubscribe mechanism.

17. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, available at https://caddonline.ca/privacy-policy/. By agreeing to these Terms, you also acknowledge that you have read and agree to our Privacy Policy.

18. Force Majeure

CADD shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, labour disputes, equipment failure, or interruptions in telecommunications or internet services.

19. Amendments to Terms

CADD reserves the right to terminate access to the website for users who violate these termsWe may update these Terms from time to time at our sole discretion. Changes will be posted on this page with an updated effective date. Material changes will be communicated to enrolled students via email. Continued use of our services after changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically..

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any written agreements signed by both parties, constitute the entire agreement between you and Canadian Academy of Defensive Driving Inc. regarding your use of our services and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.

22. Waiver

No waiver of any provision of these Terms by CADD shall be effective unless made in writing and signed by an authorised representative of CADD. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

23. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the rules of the ADR Institute of Ontario. If mediation is unsuccessful, the dispute shall be resolved exclusively in the courts of Ontario.
